Article 1 - Definitions

In these terms and conditions, the following definitions apply:

Cooling-off Period: The period within which the consumer can exercise their right of withdrawal.

Consumer: A natural person who is not acting for purposes related to their trade, business, craft, or profession.

Day: Calendar day.

Continuing Performance Contract: A distance contract relating to a series of products and/or services, where the obligation to supply and/or purchase is spread over time.

Durable Data Carrier: Any means that enables the consumer or entrepreneur to store information directed personally to them in a way that allows future consultation and unaltered reproduction of the stored information.

Right of Withdrawal: The option for the consumer to withdraw from the distance contract within the cooling-off period.

Entrepreneur: A natural or legal person who offers products and/or services to consumers at a distance.

Distance Contract: A contract concluded between the entrepreneur and the consumer within the framework of an organized system for distance selling, where one or more means of distance communication are exclusively or partially used up to the conclusion of the contract.

Means of Distance Communication: A tool that can be used to conclude an agreement without the consumer and entrepreneur being physically present in the same place simultaneously.

Article 3 - Applicability

  • These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.
  • Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the distance contract is concluded that the general terms and conditions can be inspected at the entrepreneur’s premises and will be sent to the consumer free of charge upon request.
  • If the distance contract is concluded electronically, the text of these general terms and conditions may, by way of deviation from the previous paragraph, be made available to the consumer electronically in such a way that they can be easily stored on a durable data carrier. If this is not reasonably possible, it will be indicated before the distance contract is concluded where the general terms and conditions can be accessed electronically or otherwise, and that they will be sent free of charge upon request.
  • If specific product or service terms apply in addition to these general terms and conditions, the second and third paragraphs apply accordingly. In the event of conflicting terms, the consumer may always invoke the provision that is most favorable to them.

Article 4 - The Offer

  • If an offer has a limited validity period or is subject to specific conditions, this will be explicitly stated in the offer.
  • We always describe what we sell and how the ordering process will proceed as completely and accurately as possible. The description is detailed enough to allow you to make a proper assessment. If we use images, they are truthful representations of the goods and/or services offered. However, mistakes can happen, and if we have made an obvious error, we are not obligated to deliver the product.
  • Your order is complete, and the agreement between us is final as soon as we confirm your order by email and receive approval for your payment transaction via credit or debit card from the card issuer. We accept payments via credit card or online banking. If your card issuer refuses to authorize payment to us, we cannot be held responsible for delays in delivery or the non-delivery of your order. Orders without valid payment in the name of the registered cardholder will not be accepted or processed.
  • To purchase a product, add it to your shopping cart. Then, enter your contact and billing information. Confirm your order by pressing the button labeled "place order."
  • In case of late payment by the customer or issues with payments from previous orders, Greenwarehouse reserves the right to terminate the agreement.

Article 5 - Right of Withdrawal

  • The consumer has the right to return goods within 14 calendar days. This period begins on the day after the consumer or someone acting on their behalf receives the product.
  • The direct costs of returning the goods are the responsibility of the consumer. To facilitate the return, the consumer must download, complete, and include the return form with the returned goods.
  • We may withhold the refund until we have received the returned goods. If the return does not meet the specified return conditions, we are not obligated to refund the purchase amount.
  • If the consumer wishes to exercise their right of withdrawal, we expect careful handling of the product and its packaging. To ensure that the goods can still be returned as described above, the consumer may only unpack or use the goods to the extent necessary to determine whether they wish to keep the product. Returned goods may be tried on, but they must not be used. The original label must remain attached to the item.
    If the goods are returned, this should, if possible, be done using the original packaging, including all provided accessories, in their original condition, and in accordance with the instructions provided below.
  • The customer may send their return via post.

Article 6 - Exclusion of the Right of Withdrawal

The right of withdrawal may only be excluded by the entrepreneur if this is clearly stated in the offer, or at least communicated before the agreement is concluded.

Exclusion of the right of withdrawal is only possible for products:

  • That have been produced by the entrepreneur according to the consumer’s specifications.
  • That are clearly personal in nature.
  • That, by their nature, cannot be returned.

Article 7 - The Price

  • During the period stated in our offer, our prices will not change unless required by legal measures, interim price increases by the manufacturer, or changes in VAT rates.
  • Our prices include all taxes, VAT, levies, and services. However, we may decide to charge additional shipping costs. If applicable, this will always be communicated before you finalize your purchase.

Article 8 - Payment

  • We can only accept payments through the payment modules on our website.
  • To ensure secure online payment and the protection of your personal data, transaction details are transmitted over the internet using SSL technology. No special software is required to use SSL. You can recognize a secure SSL connection by the “lock” icon in the bottom status bar of your browser.

Article 9 - Conformity and Warranty

  • The entrepreneur guarantees that the products comply with the agreement, the specifications stated in the offer, the reasonable requirements of reliability and/or usability, and the existing legal provisions and/or government regulations at the date of the agreement.
  • A warranty arrangement offered by the entrepreneur, manufacturer, or importer does not affect the rights and claims the consumer may assert regarding a failure in the performance of the entrepreneur’s obligations under the law and/or the distance contract.
  • If a product is delivered damaged or defective, we will cover the return costs. If the customer wishes to return multiple items and the total return costs exceed this amount, we will still only reimburse the return cost for the damaged or defective product.

Article 10 - Delivery and Execution

  • All goods are delivered to the address you provided when placing your order. Greenwarehouse cannot be held responsible for errors made by the customer when entering the delivery and/or billing address, which may result in delays or the inability to deliver the ordered products.
  • If an item is in stock, it will be delivered to your address within 2 to 4 working days. These delivery times are indicative only and are not legally binding.
  • If an item is not in stock, the customer will be informed of a later delivery date via email. If the customer does not agree with the delay, the ordered product may be canceled, or the customer can choose an alternative product. The canceled product will be refunded by Greenwarehouse.
  • If we are unable to deliver on time, we will always inform you before the anticipated delivery date expires. If we fail to do so, you may cancel your order free of charge. In that case, we will refund you no later than 30 days after cancellation.
  • If the goods delivered by us are damaged during transport or do not match the items you ordered, you must report this as soon as possible and no later than 3 days after receipt. The items must be returned to us within 14 calendar days of receipt. The return costs in this case are our responsibility.
  • We cannot be held liable for any consequential damages resulting from late delivery or non-delivery by the transport company appointed by the business. In such cases, our liability is limited to the value of the items proven not to have been received by the customer.

Article 11 - Force Majeure

  • In the event of force majeure, we are not obligated to fulfill our obligations. In such cases, we may either suspend our obligations for the duration of the force majeure or terminate the agreement definitively.
  • Force majeure includes any circumstance beyond our will and control that wholly or partially prevents the fulfillment of our obligations. This includes, but is not limited to, strikes, fire, operational disruptions, energy outages, disruptions in a (telecommunications) network or connection, or communication systems used, and/or the unavailability of our website, as well as delayed or non-delivery by suppliers or other third parties engaged by us.

Article 12 - Complaints Procedure

Complaints regarding the execution of the agreement must be submitted to the entrepreneur within a reasonable time after the consumer has identified the defects. Complaints must be described fully and clearly.

Complaints submitted to the entrepreneur will be answered within 7 days from the date of receipt. If a complaint requires a foreseeable longer processing time, the entrepreneur will respond within 7 days with an acknowledgment of receipt and an indication of when the consumer can expect a more detailed response.

The consumer must give the entrepreneur at least 14 days to resolve the complaint in mutual consultation.
